General Terms and Conditions for Electronic Identification
1. Introductory Provisions
Lyptoex Crypto d.o.o. is a provider of virtual currency services, with its registered office at Zaloška cesta 1, 1000 Ljubljana, registration number: 9328904000, tax number: 9328904000, contact: info@Lyptoex.net (hereinafter referred to as “Lyptoex Crypto”).
This General Terms and Conditions for Electronic Identification (hereinafter referred to as the “Terms”) governs the process of User identification in the process of entering into a business relationship between Lyptoex Crypto and the User.
The business relationship between the User and Lyptoex Crypto shall only be concluded if the User is properly identified.
In the event of the conclusion of a business relationship between the User and Lyptoex Crypto, a contract shall be concluded, consisting of the General Terms and Conditions, the Privacy Policy, and other documents available on the website www.gatehub.net (collectively, the “Contract”).
Terms used in this Policy that are not explained are explained in other documents of the Contract
2. Electronic identification
Electronic identification is a way of identifying and verifying the customer’s identity while establishing a business relationship with Lyptoex Crypto. It is carried out by remote electronic means.
Electronic identification involves technology to identify the customer via an internet connection.
Electronic identification is carried out in English.
Electronic identification is carried out within the web application “Electronic ID”, of the company Signicat AS.
As part of the electronic identification process, the User is required to enter certain data in an electronic form.
A User who has been successfully identified using electronic identification shall be deemed to have fulfilled the condition for entering into a business relationship with Lyptoex Crypto. This shall make available to the User all the services available to fully registered Users in accordance with the Contract.
The manner of implementation of electronic identification is regulated by Article 35 of the Act on Prevention of Money Laundering and Terrorist Financing (ZPPDFT-2).The technical conditions for the implementation of electronic identification are regulated by a sub-legislative act of the ZPPDFT-2 – the Regulation on technical conditions to be met by secure remotely operated or electronic procedures and means of identification.
3. Data
The data captured and Lyptoex Crypto shall store the result of the identification for the sole purpose of using the electronic identification service for the purpose of confirming the identity of an existing customer or user when establishing a business relationship with Lyptoex Crypto.
Users’ personal data processing is governed by the Privacy Policy, which is available on the GateHub Crypto website.
4. Implementation of electronic identification
The electronic identification service is available to Users at any time.
The User may also identify himself in other ways if required by the Terms of Use in force from time to time.
The electronic identification process is free of charge for the User.
5. User
To access the electronic identification service, the User needs:
- PC, tablet (both with webcam), or smartphone with front-facing camera or device (with browser);
- a valid identity document;
- a stable internet connection;
- a well-lit room.
6. Electronic identification procedure
i. The user chooses the method of identification by electronic identification.
ii. Before starting the process, the application informs the User about what is required for the electronic identification process and obtains consent for collecting and processing personal data.
iii. The user’s consent to:
- implementing electronic identification;
- making and keeping a record of the procedure;
- taking and storing screenshots of the User’s image and his/her identity document.
iv. The electronic identification process verifies:
- matching the customer’s previously entered data with the data on the User’s identity document;
- the security features of the User’s personal document;
- the logical consistency of all the data collected;
- the customer’s behavior during identification.
v. The process is concluded with a successful or unsuccessful electronic identification.
vi. In the event of successful electronic identification, the business relationship with the User is deemed to have been concluded and the User is granted access to the Lyptoex Crypto services.
vii. In case of unsuccessful electronic identification, the User may try again. In the event of unsuccessful electronic identification again, the User must make the identification in person.
7. Collection of personal data
Personal data in the context of electronic identification shall be collected in the manner prescribed by applicable law. The same applies to the processing and storage of such data.
The following personal data of the User and other data are collected in the context of electronic identification:
- name and surname;
- address of permanent residence;
- date of birth;
- place of birth;
- nationality;
- Document ID No;
- the name of the issuer of the ID document;
- Document ID type;
- the date of issue of the ID document;
- the date of validity of the ID document;
- date and time;
- a photo of the front and back of the ID document;
- a photo of the customer during the electronic identification process.
8. Rights of Lyptoex Crypto and the User
Lyptoex Crypto may refuse electronic identification if it has valid reasons for doing so. It is not obliged to inform the User of these reasons.
Lyptoex Crypto may request the User to provide additional information if necessary for the Client’s complete due diligence. The User must provide this information in the manner and within the timeframe specified by Lyptoex Crypto. If the User does not provide all requested information or does not provide it within the timeframe, Lyptoex Crypto cannot complete the User identification process.
The user may interrupt the identification procedures at any time. The reasons for termination do not need to be explained.
The User may at any time request Lyptoex Crypto to provide all the data held by Lyptoex Crypto and obtained in the context of the implementation of electronic identification.
Final provisions
The mutual rights and obligations between the parties not agreed in this Policy shall be agreed in the Contract.
